Terms of Service

Short version: Nitrograph helps agents discover and inspect services. You control what your agent sends, which services it calls, and what it pays for. Inspect before invoking paid services, and do not send secrets or raw customer payloads to Nitrograph.

1. Scope

These Terms of Service govern your use of nitrograph.com, api.nitrograph.com, the Nitrograph MCP server, the Nitrograph CLI/npm package, documentation, and related services provided by Nitrograph Inc. ("Nitrograph," "we," "us," or "our").

By using Nitrograph, you agree to these terms. If you use Nitrograph on behalf of an organization, you represent that you are authorized to bind that organization.

2. What Nitrograph Provides

Nitrograph helps agents discover, rank, and inspect third-party services. Nitrograph may return service metadata, pricing signals, health signals, call cards, gotchas, proven patterns, and payment information.

Nitrograph is not the third-party service your agent ultimately calls. Unless expressly stated otherwise, your agent calls selected third-party services directly, and those services are governed by their own terms, privacy policies, payment rules, and availability.

3. Your Responsibilities

You are responsible for how you configure and use agents, MCP clients, CLI tools, harnesses, wallets, payment sessions, and third-party services.

You must not submit secrets, private keys, bearer tokens, passwords, regulated data, sensitive personal information, confidential customer data, raw customer payloads, or full downstream service responses to Nitrograph unless you have the rights and legal basis to do so.

You are responsible for reviewing service details, pricing, payment requirements, and call cards before invoking a paid service.

4. Payments and Third-Party Services

Some Nitrograph flows or third-party service calls may require payment, including x402 or other payment rails. Payment requirements may be surfaced through payment challenges, payment links, wallet flows, or service metadata.

A payment challenge, including a 402 Payment Required response, is not a completed third-party service call and should not be treated as proof that a third-party service failed.

Nitrograph does not custody private keys. You are responsible for wallet security, transaction approval, payment settlement, taxes, chargebacks, disputes, and compliance obligations that apply to your use.

5. Outcome and Pattern Reports

If you or your agent submit outcome reports, diagnoses, suggested fixes, workflow steps, or pattern reports, you grant Nitrograph permission to use that information to operate and improve the service, including ranking, health signals, gotcha promotion, and proven-pattern promotion.

Reports should be concise and operational. Do not include secrets, credentials, private keys, sensitive personal information, confidential customer data, raw customer payloads, or full downstream service responses.

6. Acceptable Use

You may not use Nitrograph to violate law, infringe rights, abuse third-party services, bypass payment requirements, attack systems, scrape in violation of applicable terms, submit malicious content, or interfere with Nitrograph's operation.

We may rate limit, suspend, block, or remove access if we believe use is abusive, unsafe, unlawful, or harmful to Nitrograph, users, service providers, or payment networks.

7. Availability and Changes

Nitrograph is provided as an evolving service. Rankings, service metadata, health signals, call cards, docs, APIs, and payment flows may change over time.

We may modify, suspend, or discontinue parts of Nitrograph at any time. We may update these terms by posting a revised version with a new updated date.

8. Disclaimers

Nitrograph is provided on an "as is" and "as available" basis. We do not guarantee that rankings are complete, that service metadata is error-free, that a third-party service will work for your task, or that a payment or service call will succeed.

Third-party services are independent from Nitrograph. We are not responsible for third-party service availability, pricing, security, output, terms, privacy practices, or payment behavior.

9. Limitation of Liability

To the maximum extent permitted by law, Nitrograph Inc. will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, lost goodwill, or service interruption arising from your use of Nitrograph or third-party services.
